Basic terms
Liability
Whose fault the incident was. Not all incidents are the fault of just
one party; sometimes there are several parties and, on occasion, liability
is split between parties
Quantum
How much the claim is worth. "Special" damages are specific
damages which are a set amount (e.g. vehicle repairs). "General" damages
are damages which need to be evaluated (e.g. injuries)
Third party
The other person involved in the incident
Case law
A case which has already been decided by the court and is used as a
guideline for similar cases going through the court process
Litigated
When a case is being litigated, this means that the case is currently
with the court. Starting the court process is known as "issuing
proceedings"
Indemnity
This is where another person, usually a company, agrees to take on a
certain risk on your behalf (usually for a fee); for example, your insurers
indemnify you against the cost of claims
